- Licensing of government-owned inventions under VA control and custody
are guided by General Services Administration regulation FPMR 101-4.1,
as revised. They may be either exclusive or partially exclusive
licenses.
- For government-owned patents, the National Technical Information
Service (NTIS) of the Department of Commerce may administer the
licensing process, but only after control is transferred from
the VA to the Department of Commerce. (Applications for license that are
not administered by NTIS are administered by the Department of
Health and Human Service.)
- Employees of the VA who apply for a license to manufacture a
government-owned invention can do so only in their capacity as private
citizens or d invention can do so only in their capacity as private
citizens or as representatives of an outside firm.
- The Administrator of the VA is authorized to consider appeals
relating to the issuance or denial of licenses.
