Date: Fri, 19 Oct 2007 13:27:00 -0700 (PDT) From: Roberta J Morris To: scievseminar07@lists.stanford.edu Subject: [scievseminar07] COMMENT for 10/24; and Boston Scientific Docket If you have never seen a docket sheet, you might want to take a gander through the one for Boston Scientific, now posted on coursework (see below). I won't assign that for this coming Wednesday because you need to decide on your patent. To do that well, you'd better make a preliminary claim chart, or rather, the left hand side of one, for the claim you think right now (probably claim 1) looks the most promising for the simulation project. YES: THAT IS WHAT YOU MUST DO FOR YOUR COMMENT. JENNY WAS RIGHT: YOU NEED LOTS OF INTERMEDIATE DUE DATES OR YOU'LL JUST PUT EVERYTHING OFF UNTIL IT'S TOO LATE. SHE DIDN'T REALLY SAY THAT, BUT THAT'S WHAT I TOOK AWAY. BUT DON'T BLAME JENNY. I'D HAVE TUMBLED TO THIS WITHOUT HER HELP ANYWAY/ YES! YOUR PRELIMINARY CLAIM CHART IS DUE TUESDAY AT 8 AM, EVEN IF YOUR TEAM IS NOT MEETING WITH ME UNTIL LATER. EACH OF YOU SHOULD individually FORMAT YOUR CLAIM 1 AND *EMAIL* IT TO ME as the **TEXT** of the message. YES, PLEASE CONVERT TO TEXT BEFORE YOU SEND. NO ATTACHMENTS. REALLY. NONE. NOT NO HOW. NOT NO WAY. IF YOU WANT TO INDICATE EMPHASIS, USE A PAIR OF *'s OR A PAIR OF _'s SURROUNDING THE TEXT IN QUESTION. Now, back to the BSC dockets. The Boston Scientific Docket sheets are now posted on courseworks in the Course Materials section, in the Boston Scientific folder. Thanks to Nick Conley for his questions that led me to obtain and post this. https://coursework.stanford.edu/portal/tool/eaca86c4-20c8-45cb-8094-4680f9961cc3?panel=Main# You will see that William Lee is NOT on the (voluminous) counsel list at all. He is also NOT on any of the counsel lists on any of the court opinions on any case where Boston Scientific was a party. There is also NO Motion or Order to permit him to appear in the court Pro Hac Vice (which means, though not literally, just for this trial). He wouldn't need to move if he were a member of the California bar, but his Wilmer Hale bio only shows one state, Massachusetts, where he has been admitted to practice. David Pritikin (Cordis lead attorney) was admitted pro hac vice in April 2002. The case was filed by an attorney at Shearman & Sterling here in P.A who is now deceased. He was a partner at Fish & Neave's New York office when I was there, and I know someone who went with him to Shearman. I will follow up. Medtronic was also a defendant in the case, filed Feb 2002 but was out by September 2002. The Cordis counterclaim was filed before electronic filing began, so it is not available on line. It was filed (and amended within a week) in October 2002. BSC amended its complaint, and Cordis amended its Counterclaim a second time in December 2002. And so on and on.
