Guns, History and Economic Liberty
Clark Neily, Senior Attorney, The Institute for Justice
Wednesday 28 October
12:45 PM – 2:00 PM
Location TBA – contact JT Bergstrom
With the US Supreme Court’s acceptance of the McDonald (Chicago) Gun case, which IJ authored an amicus brief in support of, the court is taking its first look at whether the right to keep and bear arms should apply not just against the federal government, as in Heller but against state and local governments as well, through the Fourteenth Amendment. Clark Neily, who was co-counsel for the plaintiffs in Heller, and the Institute for Justice believes that the right to armed self-defense and the right to economic liberty are closely linked by virtue of Reconstruction-era American history, a history that is directly relevant to recovering a complete and appropriately originalist understanding of the Privileges or Immunities Clause of the Fourteenth Amendment.
