A Reporting Party Preparing for a Hearing in an Honor Code Case
The Judicial Affairs Administrator arranges the hearings and will contact you to discuss dates that work with your schedule, and then she will work with the responding student to make sure he/she is available. In an uncontested case, if the responding student consents, you may choose not to attend the hearing.
There are bias check practices and procedures in place to ensure that the Judicial Panel is not prejudiced. If you have concerns about a bias or conflict of interest, please notify the Judicial Advisor immediately.
A hearing typically involves a presentation of the facts of the case and will include at least the following:
- Confirmation that all documents pertinent to the case have been provided and made available at the hearing, such as the charge letter, the letter of concern and the student's written statement.
- Request for the responding student to confirm his/her position.
- Questions from the Judicial Panel (for you, for the responding student or for the Judicial Officer).
- An opportunity for both you and the responding student to make statements and/or ask questions.
- Panel adjournment for deliberations, at which time you are free to leave. In an uncontested case this usually takes 10-30 minutes. In a contested case it will take longer.
- Notification from the Judicial Advisor, via e-mail, about the outcome.
As noted elsewhere on this website, if the student is found responsible, you decide the grade. A number of instructors fail the student. However, should you want information on how some instructors address grading differently, the Judicial Advisor would be happy to share a variety of approaches, as well as examples of situations where you may choose to do otherwise (for example, based on the nature of the violation).
If you would like to meet with the Judicial Officer and Judicial Advisor to learn more about the hearing process or to prepare your case, please call 650-725-2485 to schedule a "hearing preparation meeting."
