Termination of Occupancy

Students residing in Single Graduate, Couples without Children and Students with Children Housing who decide to terminate their contracts at the end of Spring Quarter or mid-summer must notify Housing Assignments by filing a Termination of Occupancy (TOC). Students in Single Undergraduate Housing are not eligible.

Students Without Autumn Housing Assignment
Students who will not have an Autumn 2009 housing assignment can choose to move out at the end of Spring Quarter:

  • May 6 for law students
  • June 15 for non-law students

OR on one of two fixed mid-summer contract end dates:

  • July 12 or
  • August 2

You will be charged rent through your selected contract end date plus late TOC fees, if applicable.

Note: Students terminating their contracts for the end of Spring Quarter who wish to remain in housing through June 15 may file a TOC with June 15 as the move-out date. Law students will be charged late departure from May 6 through their move-out date; non-law students will be charged late departure rent from June 15 through their move-out date.

by May 1 rent through selected contract end date (end of spring term, July 12 or August 2) plus late departure, if applicable
May 2 - June 12* $100 late TOC fee plus rent through selected contract end date (end of spring term, July 12 or August 2) and late departure, if applicable
June 13 - June 15 $200 late TOC fee plus rent through selected contract end date (end of spring term, July 12 or August 2) and late departure, if applicable
after June 15 will not be released from summer contract; charged full rent until move out date plus rent at the "contract breaker" rate through August 17
*Students who apply for Autumn Quarter 2009 housing and are not assigned have until May 29 to file a TOC without incurring a late TOC fee.
If You Did Not Renew In Autumn Lottery
  • Students who have an Autumn 2009-10 housing assignment but did not renew in the Autumn Lottery will not be released from their obligation to pay rent for Summer Quarter unless they move out on or before June 15.
  • This applies to students who are moving to a different category of housing or residence for Autumn Quarter as well as to students who are assigned to the same residence for summer and autumn.
If You Did Renew Your Contract For Autumn 2009-10

Students who renewed their contract for Autumn 2009-10 will not be released from their obligation to pay rent for Summer Quarter.

  1. These students may file a TOC at any time and specify their departure date. However, they will remain liable for full rent through the remainder of the Summer Quarter.
  2. Students in Single Graduate, Couples, or Students with Children housing in this situation may choose to sublet their space for summer instead of terminating.
  3. Students who cancel their autumn assignment will be responsible for full rent through their move-out date or spring contract end date, whichever is later, plus rent at the "contract breaker" rate through August 16.
  4. Students who cancel their autumn renewal and file a TOC to end their contract before the end of the Summer Quarter should expect to pay rent though your move-out date or spring end date, whichever is later, plus rent at the "contract breaker" rate for the remainder of the Summer Quarter.
  5. If no vacancies remain in a student’s category and type of housing by the end of the assignment period, July 24, the student will be released from the Summer Quarter contract with a $200 administrative fee.
  6. Please be aware – we are not able to release students from contract during Summer Quarter given the number of vacancies we have in each category of housing.

Note: Any exceptions are made at the discretion of the director of Housing Assignments and would result in a $200 contract release fee plus rent for the days in residence.  

Moving Out Spring or Mid-Summer

Students may file a TOC to move out at the end of spring term and should follow the TOC deadlines in the chart above but may not select a mid-summer contract end date. Students who do move out mid-summer may file a TOC at any time and specify their departure date. However, they will be obligated to pay full rent until the day they move out and return their keys, plus rent at the "contract breaker" rate for the remainder of the Summer Quarter.  

“Contract Breaker”

The "contract breaker" rate is the lowest rate for the category and type of housing to which the student is assigned.

  1. If no vacancies remain in that category and type of housing by the end of the assignment period, July 24, the student will be released from the Summer Quarter contract with a $200 administrative fee.
  2. Please be aware – we are not able to release students from contract during Summer Quarter given the number of vacancies we have in each category of housing.
  3. If you file a TOC to end your contract before the end of the quarter, you should expect to pay the "contract breaker" rent for the remainder of the Summer Quarter.
  4. Students who cancel their Autumn Quarter housing should follow the TOC procedures for students without an Autumn assignment.
Rescinding a Termination of Occupancy Request

OR Changing Requested Move-out Date
If you would like to rescind a TOC request, or select an alternate fixed move-out date, contact Housing Assignments as soon as possible.

  • If you are eligible to rescind a TOC request, you will be charged the late TOC fee, if applicable, that corresponds to the date you are making this request. (See the fee schedule above.)
  • Regarding both changes, Housing Assignments can only approve requests that will not impact incoming students to your residence.
  • If you request an extension to your contract, you may have to move to a different apartment or room to accommodate incoming students.
  • Make sure to include your Stanford ID number in all email correspondence with Housing Assignments so your request can be processed efficiently.
